What the trustee does.

Marsellus serves in a defined, non-discretionary role. Each service below is performed on the written direction of the beneficiary.

Land trust trusteeship

Holding record title to Florida real property under a land trust, and acting only as directed.

  • Trustee of record Accepting conveyance and holding legal title in the name of the trustee.
  • Recorded conveyance Taking title by deed containing the powers required by § 689.071(3), so the trustee’s authority is clear on the face of the record.
  • Direction of the beneficiary Executing deeds, mortgages, leases and satisfactions only on written direction.
  • Beneficial interest Recognising assignments of beneficial interest, which pass as personal property without a new deed.
  • Successor trustee Accepting appointment where an existing trust requires a replacement trustee.
  • Estoppel and verification Responding to title, lender and closing-agent requests confirming the trust and the trustee’s authority.

Trust asset & estate disposition

Bringing the tangible contents of a trust-held property to an orderly conclusion.

  • Asset search A documented search of the entire property for assets and valuables.
  • Personal effects Clearance and disposal of perishables, medicines, clothing, and personal information throughout the property.
  • Tangible personal property sales Assessing, distributing and facilitating the sale of artwork, furniture, jewellery and household property.
  • Higher-value items The same for vehicles, boats and other titled or high-value property.
  • Disposition to designated persons Packaging, shipping and delivery of items to the persons designated to receive them.
  • Disposal of remaining items Clearance of what remains once distributions are complete.
  • Contractor management Repairs and cleaning in preparation for final disposition.
  • Facilitating the sale Agent selection, price determination, listing administration and closing management.

Property management & oversight

Keeping a trust-held property secure and maintained while it is held.

  • Securing the property Locks, access control and a documented record of who holds keys.
  • Periodic inspection Scheduled checks of the property and its condition.
  • Contractor access Supervising and logging access for work performed on the property.
  • Storm readiness Preparation and post-event inspection, as Florida property requires.

Engaging the trustee.

Engagements begin with a written trust agreement between the beneficiary and the trustee, prepared by the beneficiary’s counsel. Marsellus reviews the instrument, accepts appointment, and takes title by recorded deed.
